These Terms & Conditions (the “Terms”) govern your access to and use of thevapeloft.com, your customer account, and purchases from The Vape Loft. The website and store are operated by The Vape Loft Denver, LLC (“The Vape Loft,” “we,” “us,” or “our”). By using the website or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping & Payment Policy, and Return Policy. If you do not agree, do not use the website or place an order.
1. Age and legal eligibility
The website and its age-restricted products are intended only for people who are at least 21 years old and are legally permitted to purchase the products offered in their location. By accessing the store or placing an order, you represent that you meet all applicable age and eligibility requirements.
For age-restricted pickup and local delivery, staff inspect a valid government-issued photo ID in person to verify that the recipient is at least 21 and is the intended recipient. We record a pass/fail result; we do not photograph or retain a copy of the ID, its number, or the date of birth from that inspection. A website age acknowledgment does not replace required verification. Any additional verification required by law must be completed before the sale or fulfillment, as applicable. We may refuse or cancel an order when age, identity, address, payment, product, or destination requirements are not satisfied.
2. Lawful use
You may use the website and products only for lawful purposes. You may not use the website to violate any law, interfere with security or operation, introduce malicious code, collect information about others without authorization, misrepresent your identity, or infringe the rights of another person or business.
3. Products, descriptions, and availability
Products and services may be limited by quantity, destination, fulfillment method, age, or other legal and operational requirements. We may limit, refuse, or cancel an order, including orders that appear to be unlawful, fraudulent, intended for resale, or outside an approved destination or fulfillment route.
We make reasonable efforts to present product descriptions, images, colors, prices, and availability accurately. Displays and product packaging may vary. We may correct errors, update information, change prices, limit quantities, or discontinue a product at any time. An offer is void where prohibited.
Use products only for lawful intended purposes and follow the manufacturer’s instructions, warnings, and maintenance requirements. Keep age-restricted products, liquids, batteries, hot glass, and torches away from children and pets. Use compatible chargers, do not use damaged batteries or devices, and do not leave charging unattended. Hot glass, quartz, and torch components can cause burns; allow them to cool before handling and follow the manufacturer’s ventilation and fire-safety precautions. This general notice does not replace product-specific instructions or limit your legal rights.
4. Orders and customer information
Submitting an order is an offer to purchase. An order is not accepted until we confirm it and all required payment, age, identity, product, and fulfillment checks are satisfied. We may contact you using the email address or phone number submitted with the order.
You agree to provide current, complete, and accurate account, billing, shipping, delivery, and contact information. You are responsible for activity in your customer account and for keeping access to your email and devices secure.
5. Payment
Available payment methods are displayed at checkout. Payment information is submitted to third-party payment providers and is also subject to their terms and privacy practices. Authorization of a payment does not require us to accept or fulfill an order. Taxes, shipping, delivery fees, and other approved charges are shown during checkout before the order is submitted.
6. Shipping, delivery, and pickup
Only products, destinations, and fulfillment methods shown as available at checkout may be selected. Availability shown by the website remains subject to final legal, carrier, inventory, payment, age, identity, and address review. Shipping, local delivery, and pickup are governed by our Shipping & Payment Policy.
We do not ship nicotine orders by mail or parcel carrier. Disposable vapes, e-liquids/e-juices, and nicotine pouches are excluded from parcel shipping. Eligible nicotine orders are handed over in person after the required ID check, through an approved local-delivery route or store pickup when offered. Local delivery is limited to the service area shown at checkout and requires a $25 minimum cart subtotal before taxes, delivery fees, and tips. A delivery-area match does not override product or legal restrictions. Uber is used for snack deliveries only, not nicotine deliveries.
Age-restricted orders cannot be left unattended or handed to an underage or unverified person. If the recipient is absent, lacks valid ID, or does not pass the required check, handover will be refused. Contact us to discuss the permitted next steps. Cancellation and refund handling follows the Return Policy and applicable law; any retained delivery or redelivery charge must have been disclosed and must be legally permitted. For pickup, wait for the ready-for-pickup notice and bring the order confirmation and a valid government-issued photo ID.
7. Returns, cancellations, and refunds
Returns and refunds are not self-service and require prior approval from The Vape Loft. Do not send a product back unless we provide authorization and instructions. Eligibility, exclusions, damage reporting, and refund timing are governed by our Return Policy. Prior authorization and policy deadlines do not limit remedies or time periods required by applicable law.
8. Third-party services and links
The website may use or link to services provided by payment, ecommerce, analytics, shipping, delivery, map, and other providers. Their services may be subject to separate terms and privacy policies. We do not control unaffiliated websites and are not responsible for their content or practices.
9. Intellectual property
The website's branding, text, graphics, photographs, logos, and other content are owned by or licensed to The Vape Loft and are protected by applicable law. You may use the website for personal, noncommercial shopping purposes. You may not reproduce, distribute, sell, scrape, or exploit website content without written permission, except as permitted by law.
10. Feedback and submissions
If you submit a review, comment, image, suggestion, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights. We may moderate or remove submissions that violate these Terms or applicable law.
11. Privacy
Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy. Our storefront and hosted payment pages use HTTPS. Card details entered on the Authorize.Net hosted payment form are handled by that provider; we receive payment status and transaction information needed to support the order. No transmission or storage system is completely secure. Do not send full card details or ID copies through ordinary email or text messages.
12. Disclaimer
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” We do not promise that the website will be uninterrupted or error-free. This website disclaimer does not disclaim a manufacturer’s express warranty or exclude any product warranty, remedy, or consumer right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, The Vape Loft Denver, LLC and its owners, employees, agents, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website or a purchase. Nothing in these Terms waives rights or remedies that cannot legally be waived, including liability for personal injury, defective products, fraud, or willful misconduct to the extent applicable law prohibits its exclusion or limitation.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless The Vape Loft Denver, LLC and its owners, employees, and agents from third-party claims arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.
15. Governing law and severability
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where another law must apply. If any provision is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
16. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively when posted, except where applicable law requires another form of notice or consent.
